The ongoing COVID-19 pandemic has highlighted the urgent need for the collection of disaggregated statistical data on the situation of indigenous peoples. Where such data are available, they have shown that the pandemic has affected indigenous peoples differently than other populations, requiring culturally appropriate approaches and solutions. The Permanent Forum reiterates its recommendation to Member States to collect and disseminate disaggregated statistical data on indigenous peoples, in close cooperation with indigenous peoples themselves, in order to support evidence-based policymaking and programming.

The Permanent Forum reiterates its recommendation to ILO to accommodate and guarantee the direct participation of indigenous peoples’ organizations in ILO procedures, in particular those relating to compliance with the ILO Convention concerning the Protection and Integration of Indigenous and Other Tribal and Semi-Tribal Populations in Independent Countries (Convention No. 107) and the ILO Convention concerning Indigenous and Tribal Peoples in Independent Countries (Convention No. 169) and their corresponding supervisory mechanisms. The Forum reiterates its call upon Member States to accede to the ILO Convention concerning Indigenous and Tribal Peoples in Independent Countries (Convention No. 169).

Those violations also take place in countries that have ratified the Indigenous and Tribal Peoples Convention, 1989 (No. 169). The Permanent Forum recommends that countries that have ratified that Convention update their legislation and legal systems to conform with the Convention and its provisions. The Permanent Forum welcomes the landmark ruling in October 2021 by the Supreme Court of Norway protecting Indigenous Peoples from the establishment of a windmill park that would interfere with their traditional reindeer grazing areas. The Permanent Forum urges the Government of Norway to implement the decision of the Supreme Court without delay. It also recommends that Norway urgently address the allegations of increased incidents of hate speech online and offline against the Saami peoples following the Supreme Court ruling.

The Permanent Forum urges OHCHR in the Plurinational State of Bolivia to continue and strengthen its monitoring of the human rights of the Guaraní people to address as a matter of urgency the situation of the families and communities that are subjected to forced labour and other forms of servitude and to report regularly and publicly on developments in that situation. In the area of technical assistance, the Permanent Forum urges OHCHR in the Plurinational State of Bolivia to strengthen the human rights capacities of the Guaraní authorities in Alto Parapetí and other districts where there are serious human rights violations.

Recalling the recommendation contained in the report of its fifteenth session (E/2016/43-E/C.19/2016/11, para. 52), the Permanent Forum urges States to take measures for settlement, protection and security in post-conflict areas and for the construction of durable and lasting peace, promoting the full and effective inclusion of indigenous peoples, including indigenous women, in any initiative for peace and reconciliation. The Forum also recommends that the Department of Political and Peacebuilding Affairs and indigenous peoples, including women and young people, consider indigenous peoples’ traditional conflict resolution systems for achieving durable and lasting peace.

The Permanent Forum recommends that the Human Rights Council consider:(a)The inclusion of an agenda item addressing the human rights of indigenous peoples in the ongoing work of the Council;(b) Including the human rights of indigenous peoples as part of its universal periodic review;(c)The inclusion of indigenous expertise in the new general expert advisory body being established by the Human Rights Council;(d)The interventions submitted by an expert member of the Permanent Forum to the Human Rights Council and the working groups on the ongoing reforms of the human rights mechanisms;(e) Maintaining and strengthening its expertise on indigenous peoples’ human rights issues.

The Permanent Forum urges Member States to include indigenous peoples’ rights in the outcomes of the 2019 Climate Summit called for by the Secretary- General, which will be held on 23 September 2019. The Forum also recommends that States, the United Nations system, indigenous peoples’ organizations and other partners secure funding to ensure the adequate participation of indigenous peoples at the Summit and at the preparatory meetings.
