The Permanent Forum welcomes the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women) strategy of inclusion and visibility of indigenous women, which responds to the system-wide action plan on the rights of indigenous peoples and the recommendation of the Forum (E/2014/43/Corr.1-E/C.19/2014/11/Corr.1, para. 35) on including the priorities of indigenous women in global, regional and national programmes. The Forum encourages Member States to allocate sufficient funding for the implementation of the strategy. The Forum encourages UN-Women to emphasize enhancing the participation and capacities of indigenous young women and girls and to report on progress made to the Forum at its eighteenth session.

The Permanent Forum recommends that all States Parties to International Labour Organization (ILO) Convention No. 169 implement it by training their leading public officials/civil servants to respect and fulfil its provisions. It is crucial that indigenous peoples be fully informed of the consequences of the use and exploitation of natural resources in their lands and territories through consultations, under the principle of free, prior and informed consent, with indigenous peoples concerned. Through free, prior and informed consent, future conflicts can be avoided and the full participation of indigenous peoples in consultation mechanisms, environmental impact assessments and sociocultural impact assessments can be ensured.

The Permanent Forum recognizes that many positive developments regarding the recognition of indigenous peoples and the need to protect and promote their rights have occurred over the past years and welcomes the leading role of the African Commission on Human and Peoples’ Rights and the Working Group on Indigenous Populations/Communities in Africa in recognizing indigenous peoples on the African continent and promoting their rights. Several African countries have also contributed to the development of the recognition of indigenous peoples. The Forum notes with appreciation the ratification in 2010 by the Central African Republic of the International Labour Organization (ILO) Convention concerning Indigenous and Tribal Peoples in Independent Countries (Convention No. 169); the passage by the Congo of Law No. 5-2011, on the promotion and protection of indigenous populations, and the establishment of a legal platform to address the situation of indigenous peoples in the country; the constitutional progress in Kenya in 2010; and the introduction of quotas for the Batwa indigenous people in Burundi and Rwanda. The practice by African States of supporting indigenous peoples’ rights is developing and should be encouraged.

Since the adoption of the 2030 Agenda for Sustainable Development by Member States in 2015, the Permanent Forum has repeatedly highlighted the importance of ensuring the meaningful and full participation of indigenous peoples in the implementation of the 2030 Agenda. Unfortunately, the world is not on track to meet globally agreed targets. This has been particularly evident during the period of the COVID-19 pandemic, in which existing inequities have been exacerbated, placing the survival of indigenous peoples at greater risk. During the pandemic, indigenous peoples, in particular indigenous women and girls, have not only been left behind, but have been left even further behind.

The Permanent Forum urges States and State-owned corporations to consult and cooperate in good faith with the indigenous peoples concerned in order to obtain their free, prior and informed consent before the approval of any policies, plans and projects affecting their lands or territories and other resources, particularly in connection with the development, utilization or exploitation of minerals, water and other resources, in accordance with the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum recommends that Governments, bilateral and multilateral donor and development agencies and other development partners responsible for or assisting in the implementation of sectoral strategies or other programmes affecting lands owned, occupied or otherwise used by indigenous peoples review the consistency of such strategies and programmes with internationally recognized standards for the protection of the rights of indigenous peoples and the impact of such strategies and programmes on indigenous communities and report to the Permanent Forum at its seventh session in 2008 on the results of these reviews and on any strategies adopted to address the challenges they might identify.

In October 2008, a Committee on Corporate Social Responsibility was established by under the Ministry of Employment and the Economy. The Committee is responsible for encouraging Finnish enterprises to follow all national and international regulations and standards. Also, the Committee will act as the National Contact Point for complaints concerning the inappropriate behaviour of the enterprises within the meaning of the OECD guidelines referred to above under Recommendation 15.

The Permanent Forum welcomes the study entitled “Free, prior and informed consent: a human rights-based approach” (A/HRC/39/62), prepared by the Expert Mechanism on the Rights of Indigenous Peoples. It encourages Member States, United Nations entities, including the International Labour Organization (ILO) and the World Bank, regional development banks, the private sector, civil society organizations and other stakeholders, to use the study as guidance for understanding the principle of free, prior and informed consent when working on issues of concern to indigenous peoples. The Forum also encourages indigenous peoples to use the study to guide the development of their own community protocols on free, prior and informed consent for engaging with these stakeholders.
