The Permanent Forum welcomes the fact that the principles and rules contained in the United Nations Declaration on the Rights of Indigenous Peoples have been integrated into the new constitution of the Plurinational State of Bolivia, which was ratified in a referendum held on 25 January 2009.

Considering the continued threats facing indigenous peoples living in voluntary isolation and initial contact, and given their unique vulnerability in the time of the pandemic, the Permanent Forum recommends that local populations in the territories and adjacent areas of indigenous peoples living in voluntary isolation and initial contact be prioritized in COVID-19 vaccination plans. The Forum reminds States that, by virtue of their international obligations, and specifically those contained in the American Convention on Human Rights, they must adopt measures to safeguard the life and integrity of their citizens, especially when it comes to highly vulnerable population groups, as in the case of indigenous peoples living in voluntary isolation and initial contact.

The Permanent Forum recommends that agencies, funds and programmes of the United Nations system, in collaboration with indigenous peoples ’ organizations, monitor the high levels of global violence and threats directed at indigenous women human rights defenders. The Forum calls for an immediate halt to the criminalization,
incarceration, intimidation, coercion and assassination of, and death threats to, all indigenous human and environmental rights defenders.

The Permanent Forum encourages APG to continue to give priority to its endeavours to eliminate the servitude and contemporary forms of slavery to which families and communities in Santa Cruz, especially in Alto Parapetí, and in Chuquisaca, are subjected. The Permanent Forum encourages APG, as the organization that represents the Guaraní people in the Plurinational State of Bolivia, to continue to give priority to combating these extremely serious human rights violations as part of its broader programme of reconstitution of the Guaraní people.

The Permanent Forum calls upon all States that have ratified the International Covenant on Economic, Social and Cultural Rights to develop, at national level, in partnership with indigenous peoples, benchmarks, timelines and indicators to measure progressive realization of indigenous human rights. Furthermore, the Permanent Forum supports the efforts to elaborate an optional protocol to allow for the submission of complaints under the International Covenant on Economic, Social and Cultural Rights.

Member States, the United Nations system, bodies and funds should consider the definitions of extreme poverty by indigenous peoples and in this regard should refer to the report of the independent expert on human rights and extreme poverty (E/CN.4/2005/49). The Permanent Forum has decided to appoint members of the Forum, Megan Davis, Simon William M’Viboudoulou, Valmaine Toki, Paul Kanyinke Sena, Edward John, Álvaro Esteban Pop Ac and Raja Devasish Roy, to conduct a study on national constitutions and the United Nations Declaration on the Rights of Indigenous Peoples, with a view to assessing the nature and extent of the inclusion of indigenous peoples’ human rights in national constitutions, with reference to the rights affirmed in the Declaration, to be submitted to the eleventh session of the Permanent Forum in 2012.
