The Permanent Forum welcomes the initiation of a national dialogue to discuss and achieve key constitutional reforms in the field of justice in Guatemala, and encourages the recognition of indigenous justice systems. The Forum urges Guatemala and the private sector, in addition to the World Bank and other international economic institutions, to acknowledge that serious efforts require structural economic and social reforms rather than rapid growth of gross domestic product in order to reverse widespread and growing poverty among the indigenous peoples of Guatemala. Such crucial reforms must ensure more equitable distribution and access to traditional lands for the indigenous peoples of Guatemala, consistent with the rights affirmed in the United Nations Declaration, and on the basis of respect for and legal recognition of their collective rights, including their self-determined development. Furthermore, the Forum calls upon Guatemala to reinforce the effective and full implementation of the Peace Accords.

The Permanent Forum reiterates its call to Member States to redouble their efforts to ensure disaggregated data collection on indigenous peoples (in accordance with target 17.10) and to include complementary indicators on indigenous peoples in voluntary national reports submitted by Governments for meetings of the high-level political forum on sustainable development. Data disaggregated by ethnicity will help Governments to make informed decisions in a culturally appropriate way in response to the specific needs of indigenous peoples. The Forum underlines the importance of applying a human rights-based approach to data collection, including on ethnicity.

The Permanent Forum acknowledges the entry into force on 14 April 2014 of the Optional Protocol to the Convention on the Rights of the Child on a communications procedure. In this regard, it recommends that the Office of the United Nations High Commissioner for Human Rights, the United Nations Children’s Fund, other United Nations agencies and States support the dissemination of the guide to this Optional Protocol, including its translation into different languages and the building of capacity among indigenous organizations and institutions to make effective use of the Optional Protocol in promoting and protecting the rights of indigenous children and youth.

The Forum recommends that the United Nations and Member States recognize the cultural rights of indigenous peoples which include the rights to organize oneself freely and to administer one’s own cultural, sports, social and religious institutions. As part of the active engagement of IFAD with indigenous peoples’ issues, the Permanent Forum recommends that the Indigenous Peoples Assistance Facility be incorporated into the organization’s general budget so as to guarantee sustainability and the transfer of good practices and lessons learned within IFAD programmes and projects. The Permanent Forum also recommends that the facility extend its funding directly to indigenous peoples’ organizations. Support for indigenous peoples’ organizations should have as its point of departure the co-administration and co implementation of the projects.

The Permanent Forum considers climate change to be a driver of insecurity, exacerbating conflicts over lands, territories and resources. The Forum calls upon the Security Council to consider indigenous peoples as partners. The Permanent Forum welcomes the results of the 2018 High-level Expert Seminar on Indigenous Food Systems, in particular the creation of an online global hub on indigenous food systems, and would like to recommend that the Food and Agriculture Organization of the United Nations (FAO) continue work on: (a) Indigenous young people towards the creation of a forum on indigenous young people in the coming years; (b) Indigenous food systems, in particular in relation to the links with traditional knowledge, climate change and the respect of indigenous peoples’ rights to their lands, territories and resources; (c) Indigenous women (the global campaign on indigenous women and the leadership and food security schools for indigenous women).

The Permanent Forum welcomes the efforts of the Committee on the Elimination of Racial Discrimination to construe the International Convention on the Elimination of All Forms of Racial Discrimination, regarding indigenous persons, taking into account the provisions of the United Nations Declaration on the Rights of Indigenous Peoples. The Permanent Forum recommends that the Committee request relevant State parties to the Convention to prepare the sections relating to indigenous peoples in their reports on the implementation of the Convention in consultation and cooperation with indigenous peoples.
