Climate change and environmental issues are a major threat to indigenous peoples. The Permanent Forum recommends that Member States recognize indigenous peoples’ rights to use, maintain and control their lands, territories and resources, and develop mechanisms for their inclusion in relevant decision-making processes. The Forum calls upon States to cooperate with indigenous peoples and consider their traditional knowledge in environmental impact assessment procedures and in local, regional and national development plans. The Forum also recommends that States implement inclusive environmental and land management policies, in line with the Declaration.

The Permanent Forum recommends that relevant States recognize indigenous peoples’ right to prior, free and informed consent and provide support mechanisms for involuntarily displaced indigenous peoples to be able to return to their original communities, including appropriate forms of repatriation, compensation and restitution and provision for the sustainable livelihoods of those peoples.

The Permanent Forum invites United Nations bodies with expertise on human rights, cultural rights and the traditional knowledge of indigenous peoples to provide legal and technical comments on the revised draft protocol to the Convention on Biological Diversity on access to genetic resources and the fair and equitable sharing of benefits arising from their utilization for transmission to parties to the Convention for consideration in their final negotiations.

The Permanent Forum recognizes that many positive developments regarding the recognition of indigenous peoples and the need to protect and promote their rights have occurred over the past years and welcomes the leading role of the African Commission on Human and Peoples’ Rights and the Working Group on Indigenous Populations/Communities in Africa in recognizing indigenous peoples on the African continent and promoting their rights. Several African countries have also contributed to the development of the recognition of indigenous peoples. The Forum notes with appreciation the ratification in 2010 by the Central African Republic of the International Labour Organization (ILO) Convention concerning Indigenous and Tribal Peoples in Independent Countries (Convention No. 169); the passage by the Congo of Law No. 5-2011, on the promotion and protection of indigenous populations, and the establishment of a legal platform to address the situation of indigenous peoples in the country; the constitutional progress in Kenya in 2010; and the introduction of quotas for the Batwa indigenous people in Burundi and Rwanda. The practice by African States of supporting indigenous peoples’ rights is developing and should be encouraged.

The Permanent Forum recommends that Governments, bilateral and multilateral donor and development agencies and other development partners responsible for or assisting in the implementation of sectoral strategies or other programmes affecting lands owned, occupied or otherwise used by indigenous peoples review the consistency of such strategies and programmes with internationally recognized standards for the protection of the rights of indigenous peoples and the impact of such strategies and programmes on indigenous communities and report to the Permanent Forum at its seventh session in 2008 on the results of these reviews and on any strategies adopted to address the challenges they might identify.

The 2030 Agenda is now in its third year of implementation. The Permanent Forum reiterates that countries undergoing voluntary national reviews at the high-level political forum on sustainable development should include indigenous peoples in their reviews, reports and delegations and invites States to report on good practices to the Forum at its eighteenth session.

The Permanent Forum acknowledges the Ibero-American Action Plan for the Implementation of the Rights of Indigenous Peoples of 2018 and the establishment of an indigenous peoples’ regional observatory, led by the Fund for the Development of the Indigenous Peoples of Latin America and the Caribbean, as a tool to measure the progress made in implementing the Declaration. In addition, the Forum encourages Member States and the United Nations system to strengthen cooperation with the Fund, considering its fundamental role in the region in processes of dialogue and consultation between States and indigenous peoples.
