The Permanent Forum welcomes the decision of Bolivia to make the United Nations Declaration on the Rights of Indigenous Peoples national law and to include it in the Constitution approved by the Constituent Assembly. The Forum expresses its support for Bolivia’s implementation of the Declaration through national laws and other means that lead towards the restitution of lands and territories to the indigenous peoples of eastern Bolivia. The Forum encourages Ecuador and Nepal to give due consideration to the United Nations Declaration on the Rights of Indigenous Peoples in their current constitutional processes.

The Permanent Forum takes note of the UNDP Global Programme for Electoral Cycle Support initiative, with its focus on indigenous women and youth in Latin America, and appreciates the contributions provided by donors to ensure the success of the initiative. The Forum recommends that Member States, UN-Women and UNICEF provide financial support for this important initiative for indigenous women and youth.

The Permanent Forum regrets the continuous killings, violence and harassment targeted at indigenous human rights defenders, including indigenous women, in the context of resisting mining and infrastructure projects and other such developments. The Permanent Forum therefore invites Member States to honour their human rights obligations. In this regard, the Permanent Forum welcomes General Assembly resolution 76/148 on the rights of indigenous peoples, in which States are urged to take necessary measures to ensure the rights, protection and safety of indigenous peoples, including indigenous leaders and indigenous human rights defenders, and to ensure that perpetrators are held accountable and that access to justice and remedy is guaranteed.

The Forum recommends that the United Nations and Member States recognize the cultural rights of indigenous peoples which include the rights to organize oneself freely and to administer one’s own cultural, sports, social and religious institutions. The Permanent Forum reminds the Secretary-General, through the Assistant Secretary-General for Human Rights, on the continuing relevance of monitoring and reporting on trends related to intimidation and reprisals against Indigenous Peoples who seek to engage with the United Nations. Indigenous Peoples’ representatives have a right to be protected from reprisals for their participation in meetings at the United Nations, including the Permanent Forum on Indigenous Issues and the Expert Mechanism on the Rights of Indigenous Peoples.

Considering the commitment made by the World Bank at the Conference on Poverty Reduction and Indigenous Peoples (New York, 9 and 10 May 2006) to further explore inter-agency mechanisms to support the inclusion of indigenous peoples in national poverty reduction strategies in a limited number of pilot countries, the Permanent Forum recommends that Governments, indigenous organizations, United Nations organizations and bilateral donors fully contribute to that initiative and report back to the Permanent Forum on the progress made and the opportunities and limitations encountered, with a view to replicating the initiative in other countries.

The Permanent Forum recommends that Governments, bilateral and multilateral donor and development agencies and other development partners responsible for or assisting in the implementation of sectoral strategies or other programmes affecting lands owned, occupied or otherwise used by indigenous peoples review the consistency of such strategies and programmes with internationally recognized standards for the protection of the rights of indigenous peoples and the impact of such strategies and programmes on indigenous communities and report to the Permanent Forum at its seventh session in 2008 on the results of these reviews and on any strategies adopted to address the challenges they might identify.
