The Permanent Forum expresses appreciation for Nepal being the only Asian country to ratify the Indigenous and Tribal Peoples Convention, 1989 (No. 169), in 2007. Nevertheless, it is concerning that, even 10 years after ratification, the Government has not adopted a national action plan to implement the Convention. The Forum recommends that Nepal immediately adopt a national action plan, including in line with its commitment in the outcome document of the World Conference on Indigenous Peoples. The Forum urges other Asian States to consider ratifying the Convention as per the recommendations made by treaty bodies and in the universal periodic review.

The Permanent Forum therefore requests the United Nations Office for West Africa and the Sahel to support Member States in the Sahel and the Congo basin in this work, in collaboration with indigenous peoples. In general, indigenous peoples should be invited to contribute to the implementation of the mandate of the Office. Other initiatives of importance to indigenous peoples are the Joint Force of the Group of Five for the Sahel and the Great Green Wall for the Sahara and the Sahel Initiative. The Permanent Forum invites the Office to attend its twenty-second session, to be held in 2023, to share information on progress in its work.

The Inter-Agency Support Group on Indigenous Peoples’ Issues outlined an accountability framework involving United Nations resident coordinators to assess successes and challenges in implementing the Declaration. The Permanent Forum welcomes this initiative and urges the United Nations to ensure that this process is implemented, including in Member States that withhold recognition of Indigenous Peoples.

Climate change and environmental issues are a major threat to indigenous peoples. The Permanent Forum recommends that Member States recognize indigenous peoples’ rights to use, maintain and control their lands, territories and resources, and develop mechanisms for their inclusion in relevant decision-making processes. The Forum calls upon States to cooperate with indigenous peoples and consider their traditional knowledge in environmental impact assessment procedures and in local, regional and national development plans. The Forum also recommends that States implement inclusive environmental and land management policies, in line with the Declaration.

Recognizing the dangers of mercury and other harmful contaminants in the context of extractive industries, the Permanent Forum urges States to implement comprehensive monitoring and regulation of toxic contaminants on the lands and territories of Indigenous Peoples, including the restoration of sites and water resources that have been affected. It highlights the urgent need to address the severe impact on the health of Indigenous women and children, including neurological damage from prenatal or dietary exposure, and calls for effective interventions and remediation from health and environmental impacts.

The Permanent Forum calls on States to enter into discussions with indigenous peoples whose traditional lands are now incorporated in protected areas, with a view to reaching binding agreements that will not only acknowledge the legitimate interests of wildlife conservation but also recognize and guarantee the rights of those communities under articles 8 (2), 18, 19, 26 and 32 of the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum urges the Governments of Colombia and Ecuador to take immediate action to protect the indigenous peoples whose territories are in the border area between the two countries. The Forum encourages the Office of the United Nations High Commissioner for Human Rights and the Special Rapporteur on the rights of indigenous peoples to work with the two Governments to address this situation in close cooperation with the indigenous communities concerned.
