The Permanent Forum greatly welcomes the new global indigenous peoples’ partnership initiative that UNDP is developing with the International Labour Organization (ILO) and OHCHR to promote the United Nations Declaration on the Rights of Indigenous Peoples and ILO Convention No. 169. The Permanent Forum hopes to support that initiative, working in cooperation with other actors, by providing advice during the initial phase as well as throughout the process.

The Permanent Forum reiterates its invitation to the Committee on the Elimination of Discrimination against Women to adopt a general recommendation on indigenous women by 2020, in accordance with the Declaration and other international instruments. The Forum recommends that the general recommendation on indigenous women consider issues related to the individual and collective rights to equality, non-discrimination and self-determination; social and economic rights, including the rights to decent work and to land, territory and resources; the right to water and food; cultural rights; civil and political rights; and the right to live free of any form of violence.

The Permanent Forum welcomes the invitation extended by the Maskwacis Cree and the Confederacy of Treaty Six Chiefs to the members and the secretariat to attend the United Nations Expert Seminar on treaties, agreements and other constructive arrangements between States and indigenous peoples at the Samson Cree Nation from 25 to 27 September 2006. This is a historic first United Nations expert meeting to be held on indigenous treaty territory.

Indigenous peoples have been a distinct constituency at the United Nations since 1977 and, with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly in 2007, their inherent rights were affirmed as the international minimum standard. The Permanent Forum reiterates the position of the Special Rapporteur on the rights of indigenous peoples, namely that it is unacceptable to undermine the status and standing of indigenous peoples by combining or equating them with non-indigenous entities such as minorities, vulnerable groups or local communities. Such attempts, whether by States or United Nations entities, are not acceptable and will be challenged by indigenous peoples and those mandated to defend their rights. The Permanent Forum urges all United Nations entities and States parties to treaties concerning the environment, biodiversity and the climate to eliminate the use of the term “local communities” in conjunction with indigenous peoples, so that the term “indigenous peoples and local communities” would be abolished.

The Forum notes that in order for it and the United Nations system to review the situation of indigenous children and youth, there is a need for country-specific situation analyses. Given UNICEF’s unique and long experience and expertise in that area, the Forum invites UNICEF to initiate such situation analyses on indigenous children by field offices in countries with indigenous communities. The Forum also invites UNICEF to transmit such situation analyses to the Forum.

The Permanent Forum recommends that the United Nations and United Nations system organizations ensure the effective participation of indigenous peoples at the Food Systems Summit in 2021, as well as at all the related processes conducted in advance thereof and thereafter, including the pre-summit to be held in Italy from 19 to 21 July 2021. The food systems of indigenous peoples support sustainability and care for the environment and generate healthy foods important for the eradication of hunger and the achievement of the Goals.

The Permanent Forum was presented with horrific testimonies of Indigenous children incarcerated in prisons and other holding facilities. The Permanent Forum reminds Member States to fulfil their obligations under the Convention on the Rights of the Child in relation to the arrest, detention, or imprisonment of a child. No child should be in prison. In that regard, the Permanent Forum notes the finding in 2022 of the Supreme Court of Western Australia that the extensive solitary confinement and significant reduction in liberty of children, primarily Aboriginal children, was unlawful. The Permanent Forum calls upon Australia to respect the Court decision and remove its reservation to article 37 of the Convention on the Rights of the Child. The Permanent Forum recommends that Member States review and reform their child protection policies and systems to prevent undue removal of Indigenous children from their families and communities.

The Permanent Forum recommends that the “Study on the impacts of the Doctrine of Discovery on indigenous peoples, including mechanisms, processes and instruments of redress” (E/C.19/2014/3), with references to the Declaration and particularly to articles 26 to 28, 32 and 40, be submitted to the President of the General Assembly and to Member States as a reference guide in the discussions relating to the high-level plenary meeting/World Conference on Indigenous Peoples.
