Bearing in mind that the Permanent Forum on Indigenous Issues was named at a time when the United Nations Declaration on the Rights of Indigenous Peoples had not yet been adopted, and considering that the title of the Special Rapporteur on the rights of indigenous peoples was changed, two years ago, from its previous title of “Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people”, we strongly urge the Economic and Social Council to recommend that the name of the Forum be changed to “Permanent Forum on the Rights of Indigenous Peoples”.

The Permanent Forum confirms its commitment to making indigenous children and youth an ongoing part of its work. In so doing, it acknowledges the efforts made by organizations representing indigenous peoples, United Nations bodies and States to address the urgent needs of indigenous children and youth, including in the areas of education, health, culture, extreme poverty, mortality, sexual exploitation, militarization, displacement, removal by missionaries, incarceration and labour, among others.

The Permanent Forum welcomes the endorsement by the United Nations System Chief Executives Board for Coordination in November 2020 of a call to action to revitalize the system-wide action plan on the rights of indigenous peoples, as set out in the report entitled “Building an inclusive, sustainable and resilient future with indigenous peoples: a call to action”. In the report, the Chief Executives Board called for ensuring the more systematic participation of indigenous peoples in United Nations country processes, such as the United Nations Sustainable Development Cooperation Frameworks, and in the implementation of socioeconomic response and recovery plans and the Goals.

The Permanent Forum notes the organization of preparatory meetings for indigenous youth for its sixteenth session, including the Global Indigenous Youth Caucus meeting hosted by the Food and Agriculture Organization of the United Nations (FAO). The Forum recommends that this practice be scaled up in 2018, with representative participation of indigenous youth through indigenous peoples’ organizations from all regions, and invites FAO to report on progress achieved to the Forum at its seventeenth session.

Indigenous peoples have been a distinct constituency at the United Nations since 1977 and, with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly in 2007, their inherent rights were affirmed as the international minimum standard. The Permanent Forum reiterates the position of the Special Rapporteur on the rights of indigenous peoples, namely that it is unacceptable to undermine the status and standing of indigenous peoples by combining or equating them with non-indigenous entities such as minorities, vulnerable groups or local communities. Such attempts, whether by States or United Nations entities, are not acceptable and will be challenged by indigenous peoples and those mandated to defend their rights. The Permanent Forum urges all United Nations entities and States parties to treaties concerning the environment, biodiversity and the climate to eliminate the use of the term “local communities” in conjunction with indigenous peoples, so that the term “indigenous peoples and local communities” would be abolished.

The Permanent Forum takes note of the difficulties mentioned in the IFAD report and during the in-depth dialogue regarding engagement with partners whose approach may not be favourable to indigenous issues. The United Nations Declaration on the Rights of Indigenous Peoples has been acknowledged by IFAD as an important instrument to promote a strong focus on indigenous peoples with its partners. The Permanent Forum recommends that IFAD use the Declaration actively and engage in a constructive dialogue regarding indigenous peoples’ issues, even if its partners demonstrate a lack of interest or a less-than-positive attitude.

The Permanent Forum recommends that the President of the General Assembly at its sixty-seventh and sixty-eighth sessions convene thematic interactive hearings with the participation of Member States, representatives of indigenous peoples and the Expert Mechanism on the Rights of Indigenous Peoples, the Special Rapporteur on the rights of indigenous peoples, and the Permanent Forum, in order to facilitate the development of a concise and joint action-oriented outcome document.
