The Permanent Forum is concerned about legislative and regulatory processes that criminalize the establishment and management of community radio stations. The Forum encourages States to expressly recognize community media in their domestic law and to adopt effective actions to enforce the right of indigenous peoples and communities to have their own media.

Responses

The Government of Bolivia reports: 46. A national network of community radio stations has been set up. The Government of Namibia reports: (f) The Government of Namibia is promoting the establishment ofcommunity radios. Currently a radio station has been established in the Tsumkwe area and will be expanded to other areas where the most marginalized communities are living, provided there is an availability of resources. The Government of Mexico reports: 28. CDI issues legal opinions aimed at the conduct of technical and legal studies of draft legislation prepared by federal or local lawmakers, in which legal modifications are proposed to provide the basis for the recognition of indigenousrights or mechanisms to ensure their effective enjoyment. In that context, legal opinions have been issued on the possibility of: (a) Establishing the right to acquire, operate and manage communication media for indigenous peoples and communities; and (b) Establishing access for concession and permit holders to new technologies, and including stations belonging to indigenous peoples and communities. The Government of Colombia reports that there 16 indigenous-run public interest radio stations in the country, reaching approximately 60% of Colombia's indigenous people.
