The Permanent Forum recommends that in the case of projects affecting indigenous peoples, States ensure that transnational corporations and other business enterprises comply with specific standards contained in the United Nations Declaration on the Rights of Indigenous Peoples and ILO Convention No. 169.

Responses

Finland reports (2010): Finland promotes the standards set by the United Nations Declaration on the Rights of Indigenous Peoples on the respect of human rights and non-discrimination of indigenous peoples. In addition to the relevant legislation on corporations, a special committee consisting i.e. of representatives of the social partners has been established to promote corporate social responsibility of Finnish transnational corporations and other business enterprises. Also the OECD Guidelines for Multinational Enterprises, the United Nations Global Compact policy initiative and ILO Tripartite Declaration on Multinational Enterprises and Social Policy are relevant reference documents at the national level. The Spanish Government reports (E/C.19/2010/12/Add.9) that it agrees that this is an issue that calls for special attention and, accordingly, under the Indigenous Programme, is seeking to promote a process of dialogue and awareness raising and thereby to ensure that the rights of indigenous peoples are respected by Spanish business enterprises whose activities have an impact on their territories. In October 2009, in order to associate the AECID technical cooperation services with these efforts, a workshop was held at the Spanish Cooperation Training Centre in Montevideo, Uruguay, on cooperation with indigenous peoples: implementation of ILO Convention No. 169, to provide AECID technical and managerial personnel with the necessary guidelines and methology for effective implementation of the provisions of the Convention.
