The Permanent Forum recommends that OHCHR conduct in 2007, in consultation with indigenous peoples’ organizations, non-governmental organizations, experts, States and multilateral and bilateral agencies, the formulation of guidelines directed to all actors, both governmental and non-governmental, dealing with the respect and protection of the rights of indigenous peoples in voluntary isolation and initial contact.
This effort with regard to the land issue is embodied in the implementation of the Protection of Indigenous or Aboriginal Peoples in Isolation or Initial Contact Act (Act No. 28736). As a consequence of this Act:(a)Priority is given to the issue of land protection and indigenous peoples are classified under two categories: communities that have political and administrative recognition, such as those of the Andean and Amazonian peoples; and communities in voluntary isolation or initial contact, which are still in the process of preservation; and b.)Five territorial reserves have been established for the indigenous people who inhabit them. Pursuant to the Act, they are being classified by category in accordance with Supreme Decree No. 008-2007-MIMDES, which regulates Act No. 28736.
OHCHR: Recommendations were made to continue to disseminate information and to conduct capacity-building activities regarding the United Nations human rights mechanisms, to prepare guidelines on the protection of indigenous peoples in voluntary isolation and initial contact and to report on the results of the High Commissioner’s study on the scope and content of the relevant human rights obligations related to equitable access to safe drinking water and sanitation under international human rights instruments. In November 2006, OHCHR, in cooperation with the Government of Bolivia, the Confederación de Pueblos Indígenas de Bolivia and the International Work Group on Indigenous Affairs, organized an expert seminar on indigenous peoples in voluntary isolation and initial contact of the Amazon and Chaco region of South America. One of the recommendations of the meeting was that guidelines should be prepared that could provide guidance and best practices to policymakers, officials, non-governmental organizations and other relevant actors. Draft guidelines have been prepared and are presently under review by the Governments of the region and other partners.
