The Permanent Forum recommends that appropriate United Nations organizations, including the United Nations Development Fund for Women (UNIFEM) and the United Nations Children’s Fund (UNICEF), as well as States, take immediate action to review and monitor the situation of indigenous women and provide comprehensive reports on violence against indigenous women and girls, particularly sexual violence and violence in the context of armed conflict. Indigenous women must be full participants in this process.

The Forum recognizes that:
(a) The right to education is a key instrument for achieving equitable development and respect for cultural diversity. Education is an investment in the future, a means to reduce poverty and counter discrimination; (b) Indigenous peoples have the right, including treaty rights (as relevant) to quality primary education that is sensitive to their holistic worldviews, languages, traditional knowledge and other aspects of their cultures, which contribute to human dignity, identity, and intercultural dialogue; c) Mother-tongue mediated bilingual education is indispensable for effective learning for indigenous children and for the reduction of dropout rates; (d) Any efforts to achieve Millennium Development Goal 2 are likely to fail if impartial and effective implementation of culturally sensitive educational programs, curricula and actions addressing the needs of indigenous peoples are not undertaken; (e) indigenous children experience particular difficulties relating to access to education of quality and sociocultural relevance at all levels. Obstacles are numerous and complex and include, among others, distance to schools, differences in lifestyles, for example, nomadic and semi-nomadic communities, discrimination, violence, extreme poverty and exclusion; (f) Education can be one of the most important tools for combating prejudice and discrimination. National curricula frequently ignore the cultures, treaties, histories, and spiritual values of indigenous peoples and reinforce stereotypes; (g) In many cases, current criteria to measure the achievement of Goal 2 regarding indigenous education are absent or are based on insufficient indicators which do not reflect indigenous educational specificities and are culturally inappropriate and insensitive

Indigenous peoples should be free to continue and enhance the participation of their institutions in various processes locally, nationally, regionally and globally in forms and ways that are culturally appropriate for them and that ensure equality and non-discriminatory access. In that regard, the Permanent Forum recommends that Member States and indigenous peoples involved in international regional cooperation forums exercise an inclusive and non-discriminatory approach towards indigenous peoples living in the countries and territories covered by such forums.

The Permanent Forum expresses appreciation to all States, United Nations agencies and foundations that contributed to the Trust Fund on Indigenous Issues, including contributions for the small grants programme for the Second International Decade of the World’s Indigenous People and the Voluntary Fund for Indigenous Populations, and invites States, agencies and foundations to continue contributing generously to the Funds. The Forum urges the Voluntary Fund on Indigenous Populations to give particular support to applications from indigenous peoples from the Pacific to participate in its seventh session in 2008. The Permanent Forum encourages representatives of indigenous peoples’ organizations from the Pacific to make applications to the Fund in order to the attend the seventh session of the Permanent Forum.

The Permanent Forum demands that WIPO recognize and respect the applicability and relevance of the Declaration as a significant international human rights instrument that must inform the Intergovernmental Committee process and the overall work of WIPO. The minimum standards reflected in the Declaration must either be exceeded or directly incorporated into any and all WIPO instruments that directly or indirectly impact the human rights of indigenous peoples.

The Permanent Forum welcomes the first meeting of Escazú Agreement. The Escazú Agreement is the first instrument that includes provisions on the protection of human rights defenders in environmental matters. The Permanent Forum urges States parties to ensure implementation of the Agreement and invites them to establish mechanisms for the full and effective participation of indigenous peoples in the work thereof. The Permanent Forum reiterates its invitation to countries that have not yet signed or ratified the Agreement to do so.

The Permanent Forum recalls that, in the outcome document of the World Conference on Indigenous Peoples, Member States committed to “developing, in conjunction with the Indigenous Peoples concerned, fair transparent and effective mechanisms for … repatriation of ceremonial objects and human remains at the national and international levels”. The Forum urges United Nations entities to accurately identify affected Indigenous Peoples and provide them with advance notice and applicable timelines for both identification and repatriation so that Indigenous Peoples can request the repatriation of their ancestral remains, cultural patrimony and sacred objects.
