The Permanent Forum recommends that WIPO commission the updating of the technical review of key intellectual property-related issues of the WIPO draft instruments on genetic resources, traditional knowledge and traditional cultural expressions, which was undertaken in 2016 by James Anaya (WIPO/GRTKF/IC/29/INF/10), to reflect current issues, with an emphasis on concepts such as “balancing” and “public domain” and how these might conflict with indigenous peoples’ human rights and customary laws, and the obligation to incorporate and respect human rights in the work of WIPO.

Indigenous women’s collective rights and the decolonization of State structures are essential to implementing general recommendation No. 39. The Permanent Forum recommends that the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women) conduct and present a study by 2025 on the impacts of colonization on the rights of Indigenous women and girls, including within the context of the UN-Women strategy for the inclusion and visibility of Indigenous women, in collaboration with other United Nations entities. The study should identify critical action areas and strategies to advance the implementation of general recommendation No. 39.

The Permanent Forum urges increased dialogue among Governments, institutions and indigenous peoples concerning the identification, incorporation and value of indigenous knowledge in all disaster risk reduction projects and programmes at the national and regional levels. The Forum recommends that the United Nations Office for Disaster Risk Reduction take into consideration the study on engaging indigenous peoples more inclusively in the disaster risk reduction process (E/C.19/2013/14) as part of the official documentation of the third World Conference on Disaster Reduction, to be held in 2015.

The Permanent Forum welcomes the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women) strategy of inclusion and visibility of indigenous women, which responds to the system-wide action plan on the rights of indigenous peoples and the recommendation of the Forum (E/2014/43/Corr.1-E/C.19/2014/11/Corr.1, para. 35) on including the priorities of indigenous women in global, regional and national programmes. The Forum encourages Member States to allocate sufficient funding for the implementation of the strategy. The Forum encourages UN-Women to emphasize enhancing the participation and capacities of indigenous young women and girls and to report on progress made to the Forum at its eighteenth session.

The Permanent Forum calls upon the Intergovernmental Committee to appoint representatives of indigenous peoples as members of any Friends of the Chair groups and as co-chairs of any working groups and drafting groups that may be established by the Committee. The Permanent Forum welcomes the recognition and inclusion of indigenous peoples’ knowledge in the work of the Intergovernmental Science-Policy Platform on Biodiversity and Ecosystem Services to assess the state of biodiversity and ecosystem services. The Forum supports the Platform’s approach to recognize and work with indigenous knowledge throughout its work programme, for example, recognizing the contribution of indigenous knowledge in its global assessment on the conservation and sustainable use of biodiversity and ecosystems. The Forum invites the Platform to continue to inform the Forum about the progress of its work, including at its seventeenth session.

The Permanent Forum, reaffirming the recommendations on health made at its first, second and third sessions, further recommends that all relevant United Nations entities, especially WHO, the United Nations Children’s Fund (UNICEF) and UNFPA, as well as regional health organizations and Governments, fully incorporate a cultural perspective into health policies, programmes and reproductive health services aimed at providing indigenous women with quality health care, including emergency obstetric care, voluntary family planning and skilled attendance at birth. In the latter context, the roles of traditional midwives should be re-evaluated and expanded so that they may assist indigenous women during their reproductive health processes and act as cultural brokers between health systems and the indigenous communities’ values and world views
