Many indigenous peoples described situations where their human rights were being impacted by large-scale infrastructure projects, natural resource extraction and industrial agriculture activities in their territories without their free, prior and informed consent. The Permanent Forum received information to that effect from the Shuar, Sapara, Maasai and Ogaden peoples, among others. The Forum is concerned, in particular, by cases where it appears that the interests of investors are better protected than the rights of indigenous peoples. It reiterates that States and the private sector must respect the human rights of indigenous peoples by ensuring the effective implementation of the United Nations Declaration on the Rights of Indigenous Peoples and the Guiding Principles on Business and Human Rights.

The Permanent Forum on Indigenous Issues takes account of the diversity of national experience with surveys, censuses and other data and information-collection systems as applied to indigenous peoples, and in view of the urgent need for disaggregated data on indigenous peoples within all of the mandated areas for developing and streamlining the policies and guidelines of the work of United Nations agencies, funds and programmes, and also in view of the complexities of producing coherent data, reiterates the recommendation made at its first session to organize a workshop on the subject, and recommends that the Economic and Social Council adopt draft decision 1 contained in chapter I, section A, of the present report.

The Permanent Forum recalls the recommendations contained in paragraphs 48 and 56 of the report of the international expert group meeting on indigenous youth (E/C.19/2013/3), emphasizing that linguistic education and linguistic sovereignty are of fundamental importance to indigenous peoples. The Forum recommends that the United Nations Educational, Scientific and Cultural Organization (UNESCO), UNICEF and other competent bodies of the United Nations convene, together with the Forum, a meeting of experts on intercultural matters and bilingual education.

The Permanent Forum acknowledges IFAD for the implementation of its policy on indigenous peoples and for selecting “Indigenous peoples’ food systems and sustainable livelihoods” as the theme of the second global meeting of the Indigenous Peoples’ Forum at IFAD. The Forum expects that IFAD will continue to strengthen its engagement with indigenous peoples in its future work by ensuring engagement at the country level through targeted programmes, capacity-building for indigenous peoples and project staff and the development of specific indicators on the well-being of indigenous peoples.

The Permanent Forum recognizes that, owing to historical and ongoing discriminatory practices in the delivery of healthcare, including in the administration of vaccines, there is distrust that needs to be acknowledged and addressed by governments. Therefore, the Forum recommends that governments collaborate with indigenous peoples’ representatives and leaders, provide culturally appropriate information in indigenous peoples’ languages, engage with indigenous healthcare practitioners and support indigenous peoples’ organizations that are already providing pandemic-related support in their communities.

The Permanent Forum is equally alarmed at the many testimonies from Indigenous Peoples on the establishment of protected areas and conservation measures without the free, prior and informed consent of Indigenous Peoples and the persistent violations of their human rights in the context of conservation. The Permanent Forum underlines that it is the responsibility of Member States and other actors to obtain free, prior and informed consent directly from Indigenous Peoples when developing policies and legislation pertaining to conservation measures and protected areas.

The Permanent Forum congratulates IFAD for the work undertaken in India on disaggregating the human development index and associated development indicators for indigenous and non-indigenous peoples. It further recommends that the Fund, in collaboration with the World Bank, the Inter-American Development Bank and other appropriate organizations, undertake similar work in any developing country where existing data allow for estimates of disaggregated development indicators.

The Permanent Forum has, in recent years, expressed considerable concern regarding the situation of indigenous youth and the lack of disaggregated data thereon. In 2016, the Forum decided to include a recurring item on indigenous youth in the agenda of its annual sessions and has issued several youth-specific recommendations. The Forum welcomes the progress made and encourages further action by indigenous organizations and youth, as well as by members of the United Nations Inter-Agency Network on Youth Development and the Inter-Agency Support Group on Indigenous Peoples’ Issues, in implementing those recommendations.

The Forum recommends that the United Nations Educational, Scientific and Cultural Organization, United Nations agencies and other relevant bodies provide more funds, through appropriate means, to help indigenous peoples for education, in particular, emphasizing the importance of bilingual and inter-cultural training for indigenous persons. Such funds should be used to facilitate the educational exchanges between indigenous peoples and others in order to make contributions to the cultural diversity of the world, as well as to preserve indigenous peoples’ cultural heritage.

States should:
(a) Endorse intercultural education as national policy priority to ensure equal access for indigenous children to quality and culturally appropriate primary education, as stipulated in the Convention on the Right of the Child; (b) Increase substantially State budgetary allocations in order to meet Millennium Development Goal 2 for indigenous children; c) Increase funding for Goal 2 for indigenous children through bilateral and multilateral cooperation; (d) Review current national curricula and textbooks to erase culturally discriminatory materials and enhance knowledge of indigenous cultures; (e) Establish effective arrangements for the participation of indigenous parents and community members in decisions regarding the planning, delivery and evaluation of education services for their children, including in the designing and implementation of their own education at all levels, including developing appropriate teaching materials and methods; (f) Ensure an increase in the number of indigenous persons in the educational sectors, including in policy, administration, teaching indigenous culture, history and contemporary society, indigenous languages and production of educational materials; (g) Ensure that indigenous children have access to free primary quality education; (h) Eliminate national policies and practices that create further difficulties for indigenous children to enjoy their right to education, such as the request for birth certificates for the enrolment of children and the refusal to accept indigenous names and traditional dress in schools; (i) Develop bilingual and culturally appropriate primary education for indigenous children to reduce dropout rates. The mother tongue must be the first learning language and the national language the second language; curricula should reflect indigenous peoples' holistic worldviews, knowledge systems, histories, spiritual values and physical activities, physical education and sports; (j) Recognize that isolation is a major obstacle that prevents indigenous peoples from fully enjoying their right to education. States should establish best practices, such as residential or boarding schools, where they have worked positively, and mobile and seasonal schools or the use of technologies, such as remote teaching and the Internet, to reach the most isolated and remote indigenous communities; (k) support enrolment of indigenous persons in teacher-training programs, colleges and relevant higher educational institutions; (l) Develop school curricula for indigenous peoples in cooperation with other Governments at the regional level in order to maximize the sustainable use of resources in this area; (m) Develop monitoring guidelines and indicators for achieving Goal 2 regarding indigenous children and set benchmarks in that regard; (n) In the context of the Millennium Development Goals, particularly the achievement of primary universal education, the Forum recommends that States, the United Nations system and other intergovernmental organizations pay attention to intercultural bilingual education for indigenous peoples at the preschool, primary and tertiary levels
