The Permanent Forum is concerned about legislative and regulatory processes that criminalize the establishment and management of community radio stations. The Forum encourages States to expressly recognize community media in their domestic law and to adopt effective actions to enforce the right of indigenous peoples and communities to have their own media.

The Permanent Forum decides to appoint, without financial implications, Hassan Id Balkassm and Paimaneh Hasteh, members of the Forum, as Special Rapporteurs to undertake a study to determine whether climate change policies and projects adhere to the standards in the United Nations Declaration on the Rights of Indigenous Peoples, and that the Human Rights Council expert mechanism on the rights of indigenous peoples and the Inter-Agency Support Group on Indigenous Issues be invited to participate in the study, and requests that they provide the Forum with an outline of the study at its eighth session and a report thereon at its ninth session.

The Permanent Forum recognizes development of renewable energy sources but remains alarmed that irresponsible development related to green technology and the green transition, has led, at times, to violations of Indigenous Peoples’ rights, including mineral extraction and the building of hydroelectric dams and other large-scale infrastructure without the free, prior and informed consent of Indigenous Peoples. The Permanent Forum recommends that Member States provide the resources necessary to develop and implement Indigenous Peoples’ own free, prior and informed consent protocols in such contexts.

The Permanent Forum notes the intention of the International Indigenous Women’s Environmental Justice and Reproductive Health Initiative to organize an expert group meeting on the environment and indigenous women’s reproductive health and requests that the organizers invite members of the Permanent Forum to participate in the meeting. Further, the Permanent Forum recommends that the United Nations Population Fund (UNFPA) and the World Health Organization participate in the expert group meeting.

It is stated in article 4 of the Declaration that “Indigenous peoples, in exercising their right to self-determination, have the right to autonomy or self-government in matters relating to their internal and local affairs, as well as ways and means of financing their autonomous functions”. The Permanent Forum welcomes the international seminar to assess the global status and trends with regard to indigenous autonomies, held in Mexico City in March 2019, which was organized by the Inter- American Commission on Human Rights, the Special Rapporteur on the rights of indigenous peoples, the Expert Mechanism on the Rights of Indigenous Peoples, the Permanent Forum and the International Work Group for Indigenous Affairs. The Forum calls upon States and United Nations entities to continue to discuss these issues in each region. The Forum also encourages the convening of a global conference on the state of indigenous autonomies by the three United Nations mechanisms on the rights of indigenous peoples (i.e., the Forum, the Special Rapporteur and the Expert Mechanism) and invites Member States to host the event.

The Forum requests Member States and the secretariat of the Summit to guarantee the participation of indigenous peoples at the Summit with a view to ensuring due reflection of indigenous peoples’ rights and issues in the relevant outcome documents.

The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. In that respect, the modus operandi and methods of work for enhanced Indigenous participation under article 8 (j) and related provisions The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends that a capacity-development component be included in UNDP projects that affect indigenous peoples. The Forum also recommends that the experience and knowledge of the Small Grants Programme of the Global Environmental Facility be utilized by other small-grant schemes and that a stronger link be developed between efforts to enhance the capacity of indigenous peoples’ organizations and UNDP efforts to enhance the participation of indigenous peoples in national policy processes

The Permanent Forum calls upon Member States to start the work, in the context of the United Nations Convention on the Law of the Sea, of creating a place and a voice for indigenous peoples in the governance of the world’s oceans. This effort involves the participation of indigenous peoples in all aspects of the work and decision-making regarding the Convention on the Law of the Sea, including the environmental provisions and the delimitation of the continental shelf. It may also include establishing advisory committees of indigenous peoples to guide the work under the Convention, as has been done under the Convention on Biological Diversity.

The ongoing COVID-19 pandemic has highlighted the urgent need for the collection of disaggregated statistical data on the situation of indigenous peoples. Where such data are available, they have shown that the pandemic has affected indigenous peoples differently than other populations, requiring culturally appropriate approaches and solutions. The Permanent Forum reiterates its recommendation to Member States to collect and disseminate disaggregated statistical data on indigenous peoples, in close cooperation with indigenous peoples themselves, in order to support evidence-based policymaking and programming.
