The Permanent Forum takes note of the announcement by the World Bank concerning the establishment of an indigenous peoples advisory council. The Forum recognizes the need for dialogue and will take into consideration the proposal on the understanding that the objective of such an initiative will be to ensure the participation of indigenous peoples and that the final outcome will be full compliance of the Bank’s policies, guidelines and activities with the provisions of the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum urges UNDP to further strengthen the right to self-determination of indigenous peoples by choosing indigenous peoples’ organizations as their implementing partners and responsible parties in their projects involving indigenous peoples, especially those with established track records in project implementation. As a corollary to the foregoing, government agencies created to promote and protect the rights and interests of indigenous peoples should be preferred as implementing partners in UNDP programming on indigenous peoples’ issues so that they can effectively perform their mandate

The Permanent Forum reiterates its concern about conservation efforts, including the designation of national parks, biosphere reserves and world heritage sites, which frequently lead to the displacement of indigenous peoples from their traditional lands and territories. In this regard, the Permanent Forum requests that a member of the Forum attend the thirty-fourth session of the UNESCO World Heritage Committee, to be held in Brasilia, Brazil, in August 2010.

The Permanent Forum recommends that Member States formulate evidence- based policies, long-term strategies and regulatory frameworks, in cooperation with indigenous peoples, to ensure their support and the protection and revitalization of indigenous languages, including adequate, sustained support for bilingual, mother- tongue education. The Forum also recommends that States facilitate the mainstreaming of indigenous languages. Allowing indigenous peoples to gain access to health care and other public services in their own languages will help to ensure their overall well-being.

The Forum, noting the future mandate of the World Intellectual Property Organization (WIPO) Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore to be considered by the Committee at its session to be held in July 2003, expresses the wish that the mandate of the Committee should have as its clear objective the continued development of mechanisms, systems and tools that adequately protect the genetic resources, traditional knowledge and expressions of culture of indigenous peoples at the national, regional and international levels. The Forum affirms its willingness to contribute its expertise and experience to the work of the Committee and to play a consultative role in assisting mechanisms that may be established by member States of WIPO, and urges the Committee to assist two Forum members in participating systematically and effectively in the process by establishing a special fund.

The Permanent Forum expresses concern over the misappropriation and misuse of indigenous peoples’ cultural heritage, traditional knowledge and traditional cultural expressions, and urges States and companies, in cooperation with indigenous peoples, to take effective measures to recognize and protect their rights, in accordance with article 31 of the United Nations Declaration on the Rights of Indigenous Peoples. In this regard, the Permanent Forum calls upon Member States to take measures to safeguard indigenous peoples’ rights to intellectual property by adopting laws and public policies, in which it is recognized that indigenous peoples have the right over their creations, knowledge, discoveries, works, traditional cultural expressions and other elements.
