The Permanent Forum welcomes the policy guides that are being developed by UN-Habitat, including on housing for indigenous peoples in the urban setting, which will be presented at the upcoming session of the World Urban Forum, to be held from 3 to 7 November 2008, in Nanjing, China. States are encouraged to support the production of the guidelines.

The Permanent Forum expresses concern over the misappropriation and misuse of indigenous peoples’ cultural heritage, traditional knowledge and traditional cultural expressions, and urges States and companies, in cooperation with indigenous peoples, to take effective measures to recognize and protect their rights, in accordance with article 31 of the United Nations Declaration on the Rights of Indigenous Peoples. In this regard, the Permanent Forum calls upon Member States to take measures to safeguard indigenous peoples’ rights to intellectual property by adopting laws and public policies, in which it is recognized that indigenous peoples have the right over their creations, knowledge, discoveries, works, traditional cultural expressions and other elements.

The Forum also decides to give ongoing priority to two other cross-cutting issues: a. Data collection and segregation as a follow-up of recommendations by the technical workshop on data collection; b. Human rights. The Permanent Forum urges States to address the stark inequality between indigenous and non-indigenous people in all aspects of life, which has been heightened as a result of COVID-19, by implementing in full the Indigenous and Tribal Peoples Convention, 1989 (No. 169), the United Nations Declaration on the Rights of Indigenous Peoples and the American Declaration on the Rights of Indigenous Peoples in all their legal norms and public policies related to indigenous peoples.

It encourages FAO to promote the responsible use of culturally appropriate agricultural inputs and technology so as to protect the traditional livelihoods of indigenous peoples

The Permanent Forum recommends that Member States continue to develop legislation to support genuine indigenous representation and participation in decision-making. Legislative measures that create practical, economic, legal and political difficulties for the establishment and functioning of indigenous organizations and institutions worldwide should be addressed in order to allow for cross-border and international cooperation between indigenous peoples of different countries and with and within international organizations on issues and processes affecting them.

The Permanent Forum congratulates IFAD for the work undertaken in India on disaggregating the human development index and associated development indicators for indigenous and non-indigenous peoples. It further recommends that the Fund, in collaboration with the World Bank, the Inter-American Development Bank and other appropriate organizations, undertake similar work in any developing country where existing data allow for estimates of disaggregated development indicators.

The Permanent Forum encourages United Nations entities, the World Bank, the Green Climate Fund, the African Commission on Human and Peoples’ Rights and other relevant international and regional bodies to align their policies with the United Nations Declaration on the Rights of Indigenous Peoples. Indigenous Peoples should be employed within those entities as part of diversity and inclusion policies and to ensure Indigenous perspectives.
