Given the importance of the full range of the human rights of indigenous peoples, including traditional knowledge, culturally appropriate procedures to ensure communication, information, and scheduling, the Permanent Forum calls on all United Nations agencies and intergovernmental agencies to implement policies, procedures and mechanisms that ensure the right of indigenous peoples to free, prior and informed consent consistent with their right to self-determination as reflected in common article 1 of the International Covenants on Civil and Political Rights and on Economic, Social and Cultural Rights, which makes reference to permanent sovereignty over natural resources.

The Permanent Forum urges all States to substantially increase the human and financial resources made available to all indigenous communities and schools to prevent self-harm and suicide among young people, and for holistic treatment based on cultural, spiritual and linguistic revitalization, providing healthy and positive lifestyle choices and access to traditional methods of counselling based on accurate and reliable data.

The Millennium Campaign should raise awareness about the Millennium Development Goals and indigenous peoples, providing space for indigenous youth to express their views and share experiences related to Millennium Development Goals issues, enable young indigenous people to interact with their national leaders, and facilitate networking between youth groups to crystallise new projects. Recalling the Workshop on Data Collection and Disaggregation for Indigenous Peoples (see E/C.19/2004/2 for the report of the Workshop), the Permanent Forum welcomes the ongoing collaboration with the United Nations Statistics Division in reviewing national practices in data collection and dissemination in the areas of ethnicity, language and religion. In the light of this work, as well as of the 2010 World Population and Housing Census Programme, the Permanent Forum reiterates its support to the Statistics Division as expressed in the report of the Permanent Forum on its fourth session and its recommendations contained in paragraphs 80 and 81of that report.

The Permanent Forum on Indigenous Issues has analysed and discussed indigenous fishing rights in the seas on the basis of a report submitted by the Special Rapporteurs. As a result of those discussions, the Forum considers the protection of the material basis of the culture of indigenous peoples to be a part of international law that should be applied also to fishing rights in the seas, and recommends that States in which indigenous peoples live in coastal areas recognize indigenous peoples’ right to fish in the seas on the basis of historical use and international law. In that context, the Forum notes the ongoing consultations between the Government of Norway and the Sami Parliament and recommends that the Government recognize the right of the coastal Sami to fish in the seas on the basis of historical use and international law.

The Permanent Forum reiterates its concern about information brought to its attention on continuing violations of human rights of indigenous peoples in various parts of the world, and calls upon all States to fully implement their obligations under the international human rights and humanitarian instruments. The Forum reiterates its call on States to recognize the rights of indigenous peoples constitutionally and legally, to strengthen their institutions for the promotion and protection of the human rights of indigenous peoples and to enhance awareness-raising and capacity-building efforts for government officials.

The Permanent Forum regrets the continuous killings, violence and harassment targeted at indigenous human rights defenders, including indigenous women, in the context of resisting mining and infrastructure projects and other such developments. The Permanent Forum therefore invites Member States to honour their human rights obligations. In this regard, the Permanent Forum welcomes General Assembly resolution 76/148 on the rights of indigenous peoples, in which States are urged to take necessary measures to ensure the rights, protection and safety of indigenous peoples, including indigenous leaders and indigenous human rights defenders, and to ensure that perpetrators are held accountable and that access to justice and remedy is guaranteed.
