The Permanent Forum welcomes the participation, at its seventeenth session, of the Working Group on the use of mercenaries as a means of violating human rights and impeding the exercise of the right of peoples to self-determination and invites the Working Group to conduct a study on private militaries and security companies in extractive industries and agribusiness and their impact on the human and collective rights of indigenous peoples.

The Permanent Forum takes note of the concerns expressed by the African Indigenous Peoples Caucus on the announcement by the World Bank in February 2014 of its intention to map Africa’s mineral resources by using satellites and airborne mineral surveys. The Forum calls upon the World Bank, African Governments, investor Governments and the private sector to disclose information about the “billion-dollar map” project, prior to any intervention and in a transparent manner, and requests that commitments to international norms and standards in relation to the rights of indigenous peoples be recognized and respected. The Forum also recommends that the World Bank involve indigenous peoples’ representatives in the mapping process and that indigenous peoples’ free, prior and informed consent be respected, consistent with articles 19 and 41 of the Declaration.

The Forum recommends that States pay special attention to the situation of uncontacted indigenous peoples, peoples in voluntary isolation, and peoples in isolated and remote localities and displaced peoples from indigenous communities. The Forum recommends that the Special Rapporteur on the human rights and fundamental freedoms of indigenous people pay special attention in his annual reports to the situation of these peoples. The Forum also considers that the situation of these peoples should be the subject of a special international meeting during the Second International Decade of the World’s Indigenous People.

The Forum recommends that all human rights treaty bodies and other human rights mechanisms of the United Nations and the treaty monitoring mechanisms of ILO pay special attention to the human rights of indigenous peoples, in particular indigenous women, in the discharge of their mandates. The Forum also encourages indigenous women’s organizations and other organizations working in this area to enhance their cooperation and contacts with these mechanisms.

Indigenous peoples lack recognition, and face poor implementation of their
rights and flagrant violations of their rights and their lands, while the need for their free, prior and informed consent and the right to autonomy of self-government is disregarded by local businesses and transnational corporations in mining, logging, and oil and gas extraction, among other sectors. The territories and resources of indigenous peoples are seized and livelihoods are destroyed to the detriment of their knowledge, cultures and languages. In that respect, it is important to remind Member
States of their duty to protect.

The Permanent Forum calls upon States to ensure that racial non discrimination is guaranteed in their constitutions. The term “racial discrimination” means any distinction, exclusion, restriction or preference based on race, colour, descent or national or ethnic origin that has the purpose or effect of nullifying or impairing the recognition, enjoyment or exercise, on an equal footing, of human rights and fundamental freedoms in the political, economic, social, cultural or any other field of public life. The Forum calls upon States to adhere to the peremptory norm and the absolute prohibition against racial discrimination as well as all other forms of discrimination, including gender and age.

The Permanent Forum welcomes information from the Government of Bangladesh on progress towards the implementation of the Chittagong Hill Tracts Peace Accord. The Permanent Forum urges African States, in coordination with the African Union, the African Commission on Human and Peoples’ Rights and the organizations and bodies of the United Nations system, to support/organize two regional conferences/seminars in Africa, one for French-speaking States and the other for English-speaking States, to enhance the capacity of indigenous organizations to engage in dialogues with Governments at the country level and to promote an improved understanding of indigenous issues, including through the teaching of indigenous languages at schools with the special adaptation of education to the way of life of nomadic peoples; recognizing and sustaining indigenous knowledge systems and partnerships between States and indigenous peoples on the protection of conservation areas; and inter-agency consultation on poverty reduction strategies and on designing a regional strategy to achieve the Millennium Development Goals.

The Permanent Forum reminds States that the implementation of the United Nations Declaration provides a common framework for reconciliation, justice, healing and peace. Each State has a prime responsibility and duty to protect, promote and implement all human rights, consistent with the Charter of the United Nations and international human rights law. Furthermore, all forms of discrimination must be avoided.
