The Permanent Forum welcomes the work of the Inter-Agency Support Group on Indigenous Peoples’ Issues regarding the implementation of the call to action on the theme “Building an inclusive, sustainable, and resilient future with Indigenous peoples”, in an effort to revitalize the system-wide action plan on the rights of indigenous peoples. In particular, the Permanent Forum also notes the work being carried out with and by resident coordinators to raise awareness among United Nations country teams. It encourages the Inter-Agency Support Group to continue its work on strengthening the implementation of indigenous peoples’ rights frameworks at the national level and on guaranteeing the full and effective participation of indigenous peoples at the country level.

The Permanent Forum recommends that in the case of projects affecting indigenous peoples, States ensure that transnational corporations and other business enterprises comply with specific standards contained in the United Nations Declaration on the Rights of Indigenous Peoples and ILO Convention No. 169.

The Permanent Forum has learned from indigenous peoples’ communications, which have been corroborated by the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people, that in the Chaco region there are Guaraní communities in a practical state of slavery. According to the Supplementary Convention on the Abolition of Slavery, the Slave Trade, and Institutions and Practices Similar to Slavery, as well as the articles 17, 26 and 28 of the United Nations Declaration on the Rights of Indigenous Peoples, the Forum strongly supports the efforts of the current Government of Bolivia and the commitment of the incoming Government of Paraguay to discontinue this enslaving practice and return indigenous lands to their lawful owners, the Guaraní themselves.

The Permanent Forum calls the attention of States to the need to create or strengthen national bodies with a mandate for the protection of the rights and interests of indigenous peoples in line with the Declaration. The Forum notes the efforts of certain States to create institutions for the rights and interests of indigenous peoples as Government bodies, including ombudsmen who deal with issues and situations regarding the protection of the rights and interests of indigenous peoples. It recommends that other States draw upon such experiences which highlight the promotion and protection of the rights of indigenous peoples.

The Permanent Forum recommends to the President of the sixty-eighth session of the General Assembly the continuation of the practice, established during the sixty-sixth session of the Assembly, of appointing a State representative and an indigenous peoples’ representative to conduct inclusive informal consultations on his behalf in order to build consensus on the themes of the round table and panel discussions and the content of the outcome document of the World Conference, as well as to ensure the full and effective participation of indigenous peoples in the process.

The Permanent Forum recommends that States take effective measures to halt land alienation in indigenous territories, for example, through a moratorium on the sale and registration of land, including the granting of land and other concessions in areas occupied by indigenous peoples, and also to assist indigenous communities, where appropriate, to register as legal entities.

The Forum anticipates that the host country will do its utmost to assure the issuance in a timely manner of entry visas to members of the Forum and observers from non-governmental organizations, pursuant to article IV, section 11, of the Headquarters Agreement, in order to attend its sessions. The Forum also anticipates that other member States hosting United Nations meetings to which indigenous organizations are invited will also do their utmost to ensure the timely issuance of entry visas. The Forum further requests that consideration be given to the waivering of visa fees by host countries for applicants wishing to participate in the work of the Forum and related meetings and activities.

The Permanent Forum notes the progress made in including indigenous peoples in several of the newly developed United Nations Sustainable Development Cooperation Frameworks developed in 2020 and the COVID-19 socioeconomic response plans. However, the Forum also notes the uneven inclusion of indigenous peoples in United Nations country programming consultations and development, and the lack of disaggregated data, which perpetuates their invisibility. The Forum reiterates that indigenous peoples should participate in the preparation of common country assessments as well as the Sustainable Development Cooperation Frameworks and that United Nations country teams should work with Governments to foster effective consultation with indigenous peoples.

The Permanent Forum welcomes the participation, at its seventeenth session, of the Working Group on the use of mercenaries as a means of violating human rights and impeding the exercise of the right of peoples to self-determination and invites the Working Group to conduct a study on private militaries and security companies in extractive industries and agribusiness and their impact on the human and collective rights of indigenous peoples.

The Permanent Forum takes note of the concerns expressed by the African Indigenous Peoples Caucus on the announcement by the World Bank in February 2014 of its intention to map Africa’s mineral resources by using satellites and airborne mineral surveys. The Forum calls upon the World Bank, African Governments, investor Governments and the private sector to disclose information about the “billion-dollar map” project, prior to any intervention and in a transparent manner, and requests that commitments to international norms and standards in relation to the rights of indigenous peoples be recognized and respected. The Forum also recommends that the World Bank involve indigenous peoples’ representatives in the mapping process and that indigenous peoples’ free, prior and informed consent be respected, consistent with articles 19 and 41 of the Declaration.
