In the absence of in-person sessions of the Permanent Forum for two years, the Forum expresses its appreciation of the online dialogues held with United Nations funds, programmes and specialized agencies and welcomes the continuation of this good practice in the coming years, beyond the effects of the pandemic. The Permanent Forum expresses its appreciation to the secretariat of the Forum for facilitating these dialogues and invites the secretariat to continue to do so.

The Permanent Forum is very concerned that indigenous peoples continue to report difficulties in participating in UNDP projects and engaging with UNDP offices. The Forum recommends that UNDP improve access to information on the Programme for indigenous peoples and ensure easier access to its staff members in country offices. UNDP should promote mechanisms that ensure a constructive and institutionalized dialogue between indigenous peoples and United Nations country teams at the country level, for example, by establishing advisory boards composed of indigenous representatives who can bring their perspectives to United Nations programming processes and policies.

The Permanent Forum welcomes the resolution of the seventeenth Ibero-American summit of Heads of State which calls for a world conference on indigenous peoples, to be organized by the United Nations, and urges States to support this initiative at the General Assembly level.

The Permanent Forum thus welcomes FAO efforts to develop a policy on indigenous peoples’ issues which will help organization staff to work with indigenous peoples in a more systematic way. With a view to strengthening FAO work with indigenous peoples, the Permanent Forum encourages the organization to finalize the draft policy as soon as possible and to submit it to senior management for approval.

Indigenous peoples have been a distinct constituency at the United Nations since 1977 and, with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly in 2007, their inherent rights were affirmed as the international minimum standard. The Permanent Forum reiterates the position of the Special Rapporteur on the rights of indigenous peoples, namely that it is unacceptable to undermine the status and standing of indigenous peoples by combining or equating them with non-indigenous entities such as minorities, vulnerable groups or local communities. Such attempts, whether by States or United Nations entities, are not acceptable and will be challenged by indigenous peoples and those mandated to defend their rights. The Permanent Forum urges all United Nations entities and States parties to treaties concerning the environment, biodiversity and the climate to eliminate the use of the term “local communities” in conjunction with indigenous peoples, so that the term “indigenous peoples and local communities” would be abolished.

In regard to the rights of indigenous peoples, the Permanent Forum reiterates its long-standing position of encouraging the United Nations, its organs and specialized agencies, as well as all States, to adopt a human rights-based approach. At the international, regional and national level, the human rights of indigenous peoples are always relevant if such rights are at risk of being undermined. Human rights are indivisible, interdependent, and interrelated. They must be respected in any context specifically concerning indigenous peoples, from environment to development, to peace and security, and many other issues.

The Permanent Forum recommends that Member States continue to develop legislation to support genuine indigenous representation and participation in decision-making. Legislative measures that create practical, economic, legal and political difficulties for the establishment and functioning of indigenous organizations and institutions worldwide should be addressed in order to allow for cross-border and international cooperation between indigenous peoples of different countries and with and within international organizations on issues and processes affecting them.
