The Permanent Forum expresses its appreciation to the United Nations Institute for Training and Research (UNITAR) for its training programme established to enhance the conflict prevention and peacebuilding capacities of indigenous peoples’ representatives, which has provided outstanding training for 270 indigenous representatives since 2000, and recommends that this important programme be supported henceforth through the regular budget of the United Nations.

The Permanent Forum is concerned about the reduction in indigenous-specific funding for programmes and projects by United Nations agencies, funds and programmes, for example the depletion of resources of the voluntary fund of the World Intellectual Property Organization (WIPO) for accredited indigenous peoples and local community observers. The Forum recommends that such United Nations entities ensure substantial funding to support targeted programmes and projects for indigenous peoples consistent with article 41 of the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum is very concerned that indigenous peoples continue to report difficulties in participating in UNDP projects and engaging with UNDP offices. The Forum recommends that UNDP improve access to information on the Programme for indigenous peoples and ensure easier access to its staff members in country offices. UNDP should promote mechanisms that ensure a constructive and institutionalized dialogue between indigenous peoples and United Nations country teams at the country level, for example, by establishing advisory boards composed of indigenous representatives who can bring their perspectives to United Nations programming processes and policies.

The Forum recommends that Member States adopt legislation acknowledging that the traditional knowledge of indigenous peoples is their inalienable cultural heritage and embodies their cultural identity and that they make available such legislation and information in local indigenous languages.

The Permanent Forum welcomes the initiative of UNESCO, the International Union for Conservation of Nature (IUCN), the International Council on Monuments and Sites (ICOMOS) and the International Centre for the Study of the Preservation and Restoration of Cultural Property (ICCROM) to review current procedures and capacity to ensure free, prior and informed consent, and the protection of indigenous peoples’ livelihoods, tangible and intangible heritage. During this review process, it would be advisable to review the inconsistency of approaches to natural world heritage and cultural world heritage. The Permanent Forum makes itself available to assist in the review and revision of UNESCO operational guidelines with regard to nominations and site assessments. The Permanent Forum further recommends that UNESCO invite indigenous peoples’ representatives and experts to contribute to deliberations on and recommended changes to procedures and operational guidelines.

The Forum welcomes UNDP’s contribution to the Forum and its support of the establishment of a working group on free, prior and informed consent and of the initiative to develop a land rights policy. The Forum also recognizes the key role UNDP can play in data collection and disaggregation through its national human development reports and the Millennium Development Goals reports. The Forum also recognizes that the Goals can provide an overall framework for furthering indigenous peoples’ development.

The Permanent Forum notes that representatives of extractive industries, although invited, were unable to attend the International Expert Workshop on Indigenous Peoples’ Rights, Corporate Accountability and the Extractive Industries, held in Manila from 27 to 29 March 2009. The Forum also notes that the International Council on Mining and Metals is in the process of developing a set of voluntary guidelines for the industry for engagement with indigenous peoples. The Forum invites the Council at the conclusion of the development of the guidelines to forward a copy to the secretariat of the Permanent Forum. The Forum decides to forward a copy of the report of the International Expert Workshop to the International Council on Mining and Metals.

The Permanent Forum acknowledges the efforts and initiatives of States and United Nations agencies to promote mother-tongue based multilingual education, develop health programmes and provide skills to indigenous children and youth. In this regard, the Forum encourages States and United Nations agencies to increase their efforts in a targeted and wide-scale manner to respond to the needs and priorities of indigenous children and youth, especially in the areas of education and health, in a manner that is culturally sensitive and ensures their overall well-being consistent with articles 11, 14, 41 and 42 of the United Nations Declaration on the Rights of Indigenous Peoples.
