The Permanent Forum applauds the effective participation mechanisms for indigenous peoples in such mechanisms as the Convention on Biological Diversity Working Group on article 8 (j) and related provisions, and recommends that, in accordance with the United Nations Declaration on the Rights of Indigenous Peoples, such practices be extended to all critical areas of interest to indigenous peoples, such as the Working Group on Access and Benefit-sharing and in particular the Working Group on Protected Areas.

The United Nations Declaration on the Rights of Indigenous Peoples should serve as a key and binding framework in the formulation of plans for development and should be considered fundamental in all processes related to climate change at the local, national, regional and global levels. The safeguard policies of the multilateral banks and the existing and future policies on indigenous peoples of United Nations bodies and other multilateral bodies should be implemented in all climate change-related projects and programmes.

The Permanent Forum urges States to recognize and protect indigenous peoples’ cultural right to water and, through legislation and policy, to support the right of indigenous peoples to hunt and gather food resources from waters used for cultural, economic and commercial purposes. The Forum reiterates the recommendations on the dissemination of information on indigenous issues, and invites indigenous peoples organizations, through the indigenous education caucus, to foster new forms and ways to further education and dissemination of information concerning the Forum to indigenous peoples communities and organizations, using radio programmes, publications and other appropriate cultural and educational media. The Forum recommends that the funds, programmes and organizations of the United Nations system assign appropriate resources and funds to achieve that objective.

The Permanent Forum welcomes indigenous peoples’ contributions to the implementation of the Convention on Biological Diversity and the development of the post-2020 global biodiversity framework. The Forum underlines the need to develop a new programme of work and institutional arrangements on article 8 (j) and other provisions of the Convention with the full and effective participation of indigenous peoples. It recommends that the secretariat of the Convention facilitate a capacity-building process for indigenous peoples to enable them to prepare themselves for the development of new programmes of work and institutional arrangements.

The Permanent Forum is profoundly concerned about the report of the Special Rapporteur on the right to education regarding the extensive child-labour practices in many States involving indigenous children, which represents a grave violation of their human rights, including their right to education. The Forum urges States to consider their obligations in this regard according to the United Nations Convention on the Rights of the Child and ILO Conventions No. 138 (Minimum Age Convention) and No. 182 (Worst Forms of Child Labour Convention).

The Permanent Forum recommends that the Arctic Council formally engage with the United Nations Educational, Scientific and Cultural Organization (UNESCO) and the United Nations Environment Programme (UNEP) to jointly follow up the International Experts Meeting on Climate Change and Arctic Sustainable Development: scientific, social, cultural and educational challenges (3-6 March 2009 in Monaco).
